These terms and conditions set out clearly the responsibilities we, YachtsUp Ltd, t/a YachtsUp (Companies House Registration Number 15112351) have to you, and in return you have to us, when making a booking with us.
By making a booking with YachtsUp Ltd, you agree that any dispute or claims, contractual or non-contractual, shall be exclusively subject to jurisdiction of the courts of England and Wales.
For all of our bookings, unless clearly otherwise stated, we may act in one of two manners; as a booking agent on your behalf or where your contract is directly with us for the provision of your single item booking (eg. Yacht Charter).
Where we act as an agent on your behalf, your contract is with one of our chosen suppliers, and we accept no responsibility for the proper performance of the contract. You shall be supplied with the name of the supplier on your booking confirmation. Your booking will not be financially protected and monies held by us shall on the basis that we act as an agent for the supplier concerned. Cancellation charges may apply and may be up to 100% of the charter fee, these will be detailed by the supplier and available upon request.
For single item bookings, such as yacht charter, where YachtsUp is the principal service provider, your contract is with us and the terms and conditions below shall apply. We advise you to review these terms carefully to understand your rights and obligations fully.
Booking Deposit
To secure a booking with YachtsUp, a specified non-refundable deposit is required. The deposit amount and payment confirmation will be explicitly outlined during the booking process.
Balance Payment
The total remaining balance of your booking must be settled no later than 8 weeks prior to the commencement of your holiday unless an alternative payment schedule is agreed upon at the time of booking. Details of any such payment schedule, including the division of the balance into instalments, will be clearly communicated in your booking confirmation email.
Payment Reminders
While the responsibility for timely payment rests with you, YachtsUp will send courtesy reminder emails in advance of each due date as a convenience.
Non-Payment Consequences
Failure to adhere to the payment schedule may result in the cancellation of your booking. In such an event, YachtsUp retains the right to retain any deposits paid and to apply cancellation fees as stipulated by our suppliers' terms. Should we choose to allow the booking to continue despite late payment, the overdue balance must be paid in full, including an additional administrative fee of £25 to cover the extra handling required.
Accepted Payment Methods
All payments are to be made via credit or debit card. However, YachtsUp may, at its discretion, accept payments via BACS transfer.
Currency Conversion
The cost of your booking is calculated based on a EUR/GBP exchange rate of £1.00 = €1.18. Please note that this rate is subject to change, and you will be informed of the applicable rate at the time of booking.
Price Adjustments
YachtsUp reserves the right to amend the prices of unsold holidays and to rectify any errors in the prices of confirmed bookings at any point up to the date of payment completion.
Cancellation by You
You have the right to cancel your booking at any time. To do so, you must either cancel online through our designated portal or notify us in writing via our customer service email. The effective date of cancellation will be the date on which your cancellation is received by YachtsUp.
Non-refundable items such as insurance premiums and administrative fees are excluded from any refund. Should your reason for cancellation be covered under your insurance policy, you may be eligible to reclaim these charges from your insurer.
Cancellation or Changes by Us
YachtsUp reserves the right to cancel or alter your booking at any time. In the unlikely event of cancellation, we will offer you either:
If we must cancel your booking for reasons not attributable to you, such as due to force majeure, we are liable only for any monies paid directly to us at the time of cancellation.
We aim not to make any significant changes to your booking or cancel it within 35 days of your departure date, except in the case of force majeure or if the minimum number of participants is not met. Should a major change be necessary, such as a significant alteration to the start date, quality of the yacht, or departure location, we will inform you as soon as possible.
Should we have to make a major change to your booking (including price increases of more than 10% of your holiday cost), you will have the choice to:
If you do not communicate your decision to us within the specified timeframe after notification of a significant change, we will issue a reminder. Failure to respond to the reminder may result in us treating your booking as cancelled and providing a full refund.
Compensation
If we cancel or make a significant change to your booking within 35 days of departure, except in the circumstances listed below, we will pay compensation as per the schedule outlined below.

Minor changes, which do not entitle you to compensation, may include a change of yacht to another of similar or higher standard, or adjustments to the itinerary.
Early Departure by Customer
If, for any reason, you chose to return home early while the holiday is still ongoing, you will remain responsible for paying the full cost of the booking. Early departure does not entitle you to a refund for any unused portion of the holiday, nor will YachtsUp Ltd be liable for any additional costs you may incur as a result of your decision to return early. This includes, but is not limited to, transportation costs, accommodation, and any other related expenses. Your decision to return home early will be treated as forfeiture of any remaining services of the booking, no compensation will be provided for the missed portion of the holiday.
Transfer of Booking/Name Changes
If you are unable or unwilling to continue with your booking, you may transfer to another nominated person. This person must be approved by your trip lead. The following conditions apply to the booking transfer process:
YachtsUp partners with external suppliers for various elements of your holiday experience. These suppliers, which may include yacht operators, transportation companies, and other service providers, operate under their own terms and conditions. These terms may contain provisions that limit or exclude the supplier's liability to you, especially concerning unforeseen circumstances or events beyond the supplier's reasonable control.
As part of our commitment to transparency, YachtsUp is ready to provide, upon request, copies of any such terms and conditions which are relevant to your booking. We encourage you to review these documents to fully understand the provisions governing the services provided by our suppliers. This understanding is crucial as it can affect your rights and remedies in the event of a service disruption, delay, or cancellation.
Please note that while YachtsUp carefully selects its suppliers, we are not responsible for the individual policies and practices of such third parties. Our role includes coordinating the services and facilitating your enjoyment of the holiday. However, the direct contractual relationship regarding the provision of specific services is between you and the respective supplier.

YachtsUp is committed to providing inclusive holiday experiences and will endeavour to accommodate individuals with disabilities or medical conditions wherever reasonably possible. If you or any member of your party has a medical condition or disability that may affect your holiday, please provide us with full details prior to confirming your booking, so we can assess the suitability of the planned arrangements.
We may request a medical certificate to ascertain that you are fit for the activities involved. In compliance with the Equality Act 2010, we will make reasonable adjustments to try to accommodate your needs. However, due to the specific nature of yachting holidays, there may be inherent limitations that could impact our ability to cater to every requirement.
If we are unable to accommodate the needs of the person(s) concerned in a manner that we deem safe and practical, we reserve the right not to confirm the booking. It is imperative that any change to a medical condition or the development of a new condition be reported to us immediately.
Should we not be provided with full details of any disability or medical condition at the time of booking, or upon the occurrence of any change, we may have to cancel the booking. In such cases, the applicable cancellation charges will apply.
All passengers are required to secure comprehensive travel insurance before the commencement of the holiday. The insurance must provide adequate cover for all activities you plan to undertake during your holiday and must be valid for the entire duration of your trip.
YachtsUp may request proof of your travel insurance policy at check-in. Failure to provide evidence of suitable insurance when asked may result in the refusal of boarding and cancellation of your holiday, with any payments made being retained by YachtsUp. We strongly advise you to read your policy carefully and bring documentation with you to avoid any disruptions to your travel plans.
It is the responsibility of all passengers to ensure they comply with all the necessary passport, visa, and other immigration requirements for the countries they are visiting. You must confirm these requirements well in advance of your travel date, as YachtsUp cannot accept any liability if you are unable to travel due to non-compliance.
You must ensure that your passport is valid for the duration of your holiday and for the period required by the country you are visiting. Many countries require passports to be valid for at least six months beyond the period of your stay. If you need a visa for any part of your holiday, it is your responsibility to obtain this before travel.
We recommend that you check with the relevant embassy, consulate, or visa service for all up-to-date requirements, as these can change without notice. Failure to obtain all necessary travel documents may result in you being unable to commence your holiday or enter a country, and any costs incurred as a result will be your responsibility.
YachtsUp shall not be liable for any delay, alteration, or cancellation of any booking or holiday resulting from ‘force majeure’. Force majeure events are those circumstances that are beyond our reasonable control, and which could not have been avoided even if all due care had been exercised. Such events may include, but are not limited to, war or threat of war, riot, civil strife, actual or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire, pandemics, unavoidable technical problems with transport and all similar events outside our control.
In the case of force majeure, YachtsUp will endeavour to provide alternative arrangements or a refund where possible, but it is under no obligation to do so, especially where such circumstances incur substantial expense.
Damage deposit policy shall be decided on a booking-by-booking basis, and clearly agreed by both parties prior to the commencement of the trip.
YachtsUp accepts no responsibility for the theft, loss, or damage of personal property for the entire duration of the charter.
YachtsUp is committed to protecting the privacy and security of your personal data. We process all personal information in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
During your holiday, YachtsUp and/or its representatives may take photographs and video footage which could include passengers. These images and footage may be used for a variety of purposes, including but not limited to promotional material, social media content, and other marketing efforts that showcase the experience of our holidays.
Please be aware that by participating in YachtsUp holidays, you acknowledge that other guests may take personal photos and videos that include you, which are beyond the control of YachtsUp.
Overview of Group Bookings: YachtsUp Ltd offers yacht charters that are priced based on the full occupancy of each yacht. The specific cost per person and the capacity of each yacht may vary depending on the type of yacht chosen and the nature of the charter. It is essential for groups to understand that the cost of the charter is contingent upon filling the yacht to its maximum capacity.
Full Occupancy Requirement: The total cost of chartering a yacht with YachtsUp Ltd is calculated assuming full occupancy. Groups are required to fill every space on the yacht to adhere to the agreed-upon pricing structure. This requirement applies regardless of the actual number of individuals participating in the charter.
Responsibility for Unfilled Spaces: In cases where a group booking does not meet the full occupancy requirement for a yacht, the group is responsible for covering the cost of the remaining spaces. This ensures the financial viability of the charter and maintains the exclusivity of the experience for the group.
Resolving Under-Occupancy: To address under-occupancy, the group must:

Group Leader's Role: The group leader is responsible for coordinating the booking, including ensuring that all members understand the full occupancy requirement. The group leader acts as the primary point of contact with YachtsUp Ltd for payments and communication.
Cancellation Policy for Group Bookings: Standard cancellation charges apply to group bookings. These charges may vary depending on the timing of the cancellation and the specific terms agreed upon at the time of booking. The group may be liable for costs associated with any unfilled spaces at the time of cancellation.
Flexibility in Booking: YachtsUp Ltd understands that group dynamics can change. We will endeavour to accommodate modifications to group bookings where feasible. However, changes are subject to availability and may incur additional costs.
Personal Conduct
Adherence to Yacht Rules and Respect for Authority: Guests are required to comply with all rules and guidelines established for the yacht they are sailing on. This includes respecting the authority of the skipper, whose decisions regarding the vessel and voyage are final and made in accordance with maritime laws. Guests must also respect any specific instructions or regulations set forth by YachtsUp Ltd for the duration of their charter.
Responsibility for Damages: You are responsible for any damage or loss caused by your actions or those of anyone in your party. Immediate settlement for such damages or losses is required directly to the yacht manager or relevant party. The amount will be determined by the extent of the damage and the costs of repair or replacement.
Behaviour Expectations: All guests are expected to conduct themselves in a manner that is respectful to others, including fellow guests, crew members, and any third parties encountered during the charter. Behaviour that causes or is likely to cause danger, distress, or disruption to others or to the yacht is strictly prohibited. Such conduct may include, but is not limited to, excessive noise, harassment, and reckless behaviour.
Consequences of Unacceptable Behaviour: In cases where a guest's behaviour is deemed unacceptable or in violation of these terms, YachtsUp Ltd reserves the right to terminate their travel arrangements immediately. This may result in the individual being required to disembark, with no further responsibility on the part of YachtsUp Ltd regarding their return travel or any associated costs. No refunds will be provided for terminated arrangements.
Substance Policy: The use of illegal drugs is strictly prohibited under UK law and the laws of the destination country. Violation of this policy will result in immediate termination of the guest’s participation in the trip, potential legal consequences, and the individual being reported to the appropriate authorities.
Personal Responsibility and Emergency Preparedness: It is the responsibility of each guest to ensure their own safety and well-being. Guests should be prepared for emergencies by having access to sufficient funds and maintaining communication means, such as an operational mobile phone with international roaming and a credit card.
Authority and Responsibility of the Skipper: The skipper of each yacht chartered through YachtsUp Ltd holds total responsibility and authority over the vessel and its crew, in accordance with maritime laws. This responsibility extends to all decisions regarding navigation, safety, and conduct aboard the yacht. The skipper’s primary focus is the safety of the vessel and all persons on board.
Compliance with Maritime Law: The skipper will operate the yacht in full compliance with all relevant maritime laws and regulations. This includes, but is not limited to, managing the safe navigation of the vessel, ensuring compliance with environmental regulations, and adhering to international maritime regulations.
Decision-Making Authority: The skipper has the final say in all matters relating to the operation of the yacht and the welfare of the crew and passengers. This includes decisions about itinerary alterations, weather assessments, and any necessary changes to ensure safety and compliance with laws.
