Terms and Conditions

These Terms and Conditions ("T&Cs") form the agreement between YachtsUp Ltd (trading as YachtsUp, Company Registration Number 15112351) and you, the customer. By booking with YachtsUp, you agree to these T&Cs, as well as any supplier terms relevant to your booking.

Jurisdiction

Any disputes or claims arising from your booking (contractual or otherwise) will be governed by the laws of England and Wales and subject to the exclusive jurisdiction of the English courts.

Definitions

"Supplier" refers to the third-party provider of services such as yacht hire or related activities.
"YachtsUp" refers to YachtsUp Ltd, acting as an agent or principal depending on the booking.

1. YachtsUp’s Role: Agent or Principal

1.1 Acting as an Agent

When acting as a booking agent, YachtsUp facilitates your booking with third-party suppliers.
Your contract for services such as yacht hire is directly with the supplier, and their terms and conditions govern your booking regarding:

YachtsUp is responsible only for facilitating your booking and collecting payment, but not for the performance of the supplier’s services.

1.2 Acting as a Principal

In some cases, YachtsUp acts as the principal service provider. Your contract is directly with YachtsUp for services such as the yacht charter or associated activities.
YachtsUp is fully responsible for delivering these services.
Note: Unless explicitly stated in your booking confirmation, YachtsUp acts as an agent.

2. Bookings, Pricing, and Payments

2.1 Payment Schedule

All payment schedules, including amounts and deadlines, are specified during the booking process and outlined in your invoice.
Payments must be made in accordance with these details.
Failure to make payments on time may result in cancellation (see Section 3).

Prices are calculated in GBP unless stated otherwise and may be subject to adjustment due to exchange rate fluctuations at booking.
YachtsUp reserves the right to correct pricing errors before confirmation.

For bookings made online or over the phone, you may cancel within 14 days of booking without penalty, unless:

If you cancel your booking, the following charges apply depending on written notice provided:

Note: Non-refundable items (e.g., insurance premiums) are excluded from refunds. If your cancellation reason is covered under travel insurance, you may be able to reclaim these costs.
In many cases, a Transfer of Booking/Name Change is recommended instead of cancellation.

3.2 Cancellation by YachtsUp

In rare cases, YachtsUp may need to cancel or significantly change your booking. In such cases, we will offer:

5.1 Behavioural Standards

Guests must behave responsibly, respect others, and comply with the skipper’s authority.
Dangerous or disruptive behaviour, including excessive alcohol consumption or harassment, will result in removal from the trip without refund.

5.2 Substance Policy

Illegal drug use is strictly prohibited and will result in immediate termination of the customer’s participation in the trip, with no refund provided.

6. Group Bookings

6.1 Full Occupancy Requirement

Group charters are priced based on full occupancy:
Groups are responsible for unfilled spaces.
Participants may recruit additional guests or cover the cost of vacant spaces.

6.2 Role of Group Leader

The group leader is responsible for coordinating payments and communication with YachtsUp.

7. Travel Insurance

Comprehensive travel insurance is mandatory and must cover:

Failure to provide insurance proof may result in denied participation without refund.

8. Optional Activities and Third-Party Services

Optional activities (e.g., excursions, nightlife) facilitated by YachtsUp are provided by third-party suppliers.
YachtsUp is not responsible for the performance or safety of these services.
Payments for such activities must be made directly to the supplier.

9. Skipper’s Responsibilities

9.1 Authority of the Skipper

The skipper holds ultimate authority on the yacht, in compliance with maritime laws.
The skipper’s decisions regarding navigation, safety, and onboard conduct are final.

10. Supplier Terms

Where YachtsUp acts as an agent, the supplier’s terms govern the yacht hire, covering:

11. Disabilities and Medical Conditions

Guests must disclose disabilities or medical conditions prior to booking.
YachtsUp will assess accommodations wherever possible but reserves the right to decline bookings for safety or practical reasons.

12. Data Protection

YachtsUp complies with UK GDPR:
Personal data is collected only for booking purposes and may be shared with suppliers as necessary.

13. Force Majeure

YachtsUp will not be liable for disruptions arising from events beyond our control (e.g., severe weather, pandemics, political unrest).

14. Photography and Media

By booking with YachtsUp, you consent to photography or videography during the trip for marketing purposes.
Customers may opt out by notifying us in writing, or by email.
